What Florida Law Actually Prohibits
Florida Statute 316.305 defines texting while driving as manually typing or entering multiple letters, numbers, or symbols into a wireless device to send a text, email, or instant message. Since July 1, 2019, this has been a primary offense, meaning an officer can pull you over solely for that behavior without needing another reason for the stop. Talking on a handheld phone while driving, however, remains legal under state law in most circumstances.
The exception is Florida Statute 316.306, which bans all handheld wireless device use, including phone calls, within designated school crossings, school zones, and active work zones. In those areas, drivers must use a hands-free method. The texting law also doesn’t apply when your vehicle is stationary or parked, so using a device while stopped at a red light falls outside the statute’s reach. Navigation use is similarly exempt.
