Hardship Licenses for HTO in Florida: How to Apply & Qualify

Imagine trying to hold down a job, take your kids to school, or even make a grocery run — but you can’t legally drive for five years. That’s the reality for many Floridians who get labeled Habitual Traffic Offenders (HTO). The good news: after a year, you may qualify for a hardship license that allows you to drive for work or essential needs.

What Is a Hardship License?

A hardship license is a restricted license issued by the Florida DHSMV. It doesn’t restore full driving privileges but allows you to drive for work, school, or medical purposes. The first question would be can we lift your HTO suspension, if we cannot, this maybe your only route to drive.

Who Can Apply?

  • You must serve one year of your HTO suspension before applying.
  • You must complete the Advanced Driver Improvement (ADI) course.
  • You cannot have driven while suspended during the revocation period. So, if you got another driving on a suspended license since your HTO revocation, the hardship will likely not be issued.

The Application Process

  1. Complete ADI: You’ll need proof of course completion. Make sure to use one of the ticket numbers that led to the HTO.
  2. Request a hearing: Schedule with the Bureau of Administrative Reviews (BAR).
  3. Show need: At the hearing, be prepared to explain why you need driving privileges (work, medical, family obligations).
  4. Follow restrictions: If approved, your license will be limited to specific purposes.

Common Mistakes That Delay Approval

  • Applying too early (before one year is up).
  • Failing to complete ADI.
  • Driving during suspension and getting caught — which can turn into a felony and ruin eligibility.
