Florida Divorce Laws

In Florida, you can end a marriage by either filing for a divorce or an annulment. Since Florida is a “no-fault” state, either spouse may only claim that a marriage is “irretrievably broken” without having to prove any grounds to validate the divorce.

According to the state’s residency requirement, either you or your spouse must have lived in Florida for at least six months before filing a divorce petition. The petition needs to be filed in your county’s circuit court.

There are two main types of divorce: contested and uncontested divorce. A contested divorce means that both spouses do not agree one more or more divorce issues (i.e. child custody, child support, property division, spousal support, etc.), while an uncontested divorce means both spouses agree on all issues of divorce.

A couple going through a contested divorce may resolve their issues through mediation, which allows a third-party to help both parties mutually resolve their issues in order to come to a final agreement. However, if both spouses fail to find a compromise, then their case will go to court litigation, where a judge will ultimately determine the final agreement.

On the other hand, an uncontested divorce may not involve the court until the end, when the final agreement is filed. Thus, uncontested divorces are much cheaper and quicker compared to contested divorces.
